Dream Carp Holidays (“us”, “we”, or “our”) operates the https://www.dreamcarpholidays.com/ website (“the site”)
We are an online platform which enables carp fishery owners and their managers (Fishery Owners and Fishery Managers) to advertise their fisheries and anglers to search carp fisheries and contact the fishery owners/ managers to ask questions and arrange bookings.
Reservation Request Status
On receipt of your deposit to reserve the selected dates for your chosen venue, you will be notified via an email once the Fishery Owner or Fishery Manager accepts the booking. The deposit is accepted as part payment towards the total cost of the holiday.
If a requested reservation is declined because it is not accepted by the Fishery Owner or Fishery Manager, for instance due to the availability calendar not being up to date, you will be refunded in full. The timing to receive the refund or for the pre-authorisation to be released will vary based on the payment method and any applicable payment system (e.g., Visa, MasterCard, etc.) rules.
Confirmed reservations
The outstanding balance of the holiday is required to be paid directly to the Fishery Owner or Fishery Manager. The date the outstanding balance is due is stated on your on-screen and email receipt. The Fishery Owner or Fishery Manager will notify you of the bank details to pay the outstanding balance to.
Cancelation Policy
In the event that you cancel a confirmed reservation, your deposit will not be refunded.
Force Majeure
We will not be liable for loss or delay occasioned by any of the following: Strikes, Riots, Political Unrest, Hostilities, War or threat of War, Terrorist Activity, Industrial Disputes, Fire, Flood, Technical/Weather problems to transport, Closure of Ports, Weather conditions or any other event(s) beyond our control.
Material on our site
All material on the site including content published on it, database rights, design rights belong to us and to our Fishery Owners and FIshery Managers.
It is the sole responsibility of the Fishery Owner or Fishery Manager to ensure that the information listed on the site is accurate. It is also the responsibility of the Fishery Owner or Fishery Manager to ensure that they have all required rights, authorisation to rent the fishing venue. We do not visit any of the venues advertised on the site to verify the accuracy of the advert. Nor do we make any representation or warranty that the information on the site is accurate.
Unless we provide you with written consent you are prohibited from copying, changing, transmitting or republishing material on the site.
Your safety
The site is an on-line platform which puts you in direct contact with Fishery Owners and Fishery Managers. Whilst the listing provides information on the availability of a venue and its prices, transactions are not conducted through the site, but directly between you and the Fishery Owner or Fishery Manager. Consideration should therefore be given to the communication between yourself and the Fishery Owner or Fishery Manager prior to making any payment.
Claims
Any contract relating to the hire of a fishery listed on the site is between you and the Fishery Owner or Fishery Manager. We are not party to the contract.
In light of this, by agreeing to these terms and conditions you agree that any claim you may have that is related to a dispute with a fishery on the site, must be taken up directly with the Fishery Owner or Fishery Manager and not us.
You agree to indemnify us from any and all legal disputes, claims, actions, expenses, liabilities or losses should they arise.
Our limitation of liability and responsibility
We are an online advertising service creating a marketplace where Fishery Owners and Fishery Managers can advertise fisheries. We do not own or validate whatsoever the fisheries listed on the site and we make no representation and warranties regarding any of the fisheries.
Whist Fishery Owners or Fishery Managers are required to provide accurate and truthful information on fisheries listed, if we receive a complaint from a booking party we will take reasonable action which may result in removing the listing, it is not within our control to validate the accuracy of fisheries listed on the site.
As a result, we refuse all liability and responsibility of any damages (including personal injury) or loss to you or any other party due to:
- Any user of the site placing reliance on the content within any fishery listing or other materials post on the website by a Fishery Owner or Fishery Manager
- Loss or damage to personal possession at a fishery or
- Any incident that takes place at a fishery
We shall not be liable for any direct or indirect damages or losses suffered by you.
If you identify any material on the site posted by a Fishery Owner or Fishery Manager which you deem to be, offensive, libellous, defamatory or otherwise inappropriate, please notify us using the contact details found on the site. We will review the material and decide if it is required to be removed from the site.
The information we collect about you will only be used as permitted in our Privacy Policy which can be found here. We will not collect your data without your consent. The data we collect is collected lawfully and in compliance with the UK Data Protection Act 1998 and the EU General Data Protection Regulation 2016 (GDPR).
